President Bola Tinubu has filed a plea to the Supreme Court, urging the dismissal of the appeal lodged by former Vice President Atiku Abubakar and the Peoples Democratic Party (PDP) contesting his victory in the 2023 presidential election.
Tinubu characterizes the appeal as being abusive in nature and seeks its rejection.
He firmly asserts that Atiku and the PDP failed to substantiate their allegations and contentions at the Tribunal.
Tinubu contends that the tribunal’s ruling was accurate in its judgment and validation of his election. He implores the apex court to affirm the lower court’s decision and entirely dismiss the appeal, deeming it lacking in both merit and good faith.
Atiku and the PDP filed a petition contesting the results of the presidential election held on February 25, 2023. Their petition included allegations of irregularities and significant non-compliance with the Electoral Act.
They further claimed that Tinubu and his running mate, Kashim Shettima, were ineligible to run and did not secure the election with the majority of lawful votes.
However, the Presidential Election Petition Tribunal, in its ruling on September 6, determined that Atiku failed to substantiate the claims in his petition. Consequently, the PDP candidate lodged an appeal with the apex court on September 18, 2023.
In the 35-point notice of appeal, the appellants argue that the Tribunal’s findings were marred by “serious errors and substantial misrepresentation” that led to a miscarriage of justice.
Consequently, they implore the Supreme Court to nullify the entirety of the tribunal’s findings and conclusions.
